If both parties treat each other respectfully and find solutions together, it is more likely that you will maintain a positive or at least neutral relationship after the divorce. Especially if there are children together, you will be bound to each other for life, which is why it is very important for the welfare of the children to maintain a respectful relationship in the future in order to avoid conflicts of loyalty on the part of the children.
The aim is to reach a comprehensive agreement on the ancillary consequences of the divorce by means of a divorce convention, also known as a divorce agreement. The following aspects are regulated in a divorce settlement:
- Allocation of the matrimonial home
- Child matters (custody, care, visiting rights, child maintenance)
- post-marital maintenance
- Division of assets (property settlement)
- Occupational benefits.
Another option is a partial settlement: In this case, you only conclude a divorce agreement on those matters on which you agree. The court settles the ancillary consequences that remain in dispute and issues a judgment that is binding for both parties.
