Before a separation occurs, irreconcilable differences have usually preceded it. The decision to end a relationship is associated with emotions and insecurities and requires a lot of strength. For some people, the separation may be a great relief, while for others it causes a great deal of pain. Married

Amicable separation:

The simplest and most cost-effective option is to settle the separation by mutual agreement as part of a separation agreement. If the spouses not only agree to go their separate ways, but also agree on the individual consequences of living apart, they can dissolve the joint household without court proceedings.

Disputed separation (matrimonial protection):

If the spouses are unable to reach an agreement on how to live apart or if one spouse refuses to find a solution, marriage protection proceedings must be initiated. Matrimonial protection proceedings are court proceedings in which the consequences of separation are settled at the request of one spouse.

Unmarried

Amicable separation:

Parents who are not married to each other can mutually agree on the amount of child maintenance in a maintenance agreement. In order for the maintenance agreement to be binding for the child, it must be approved by the KESB.

In a parenting agreement, the parents can regulate other child-related matters such as custody, care, visiting rights and parenting credits.

Disputed separation:

If the parents cannot agree on child maintenance, child maintenance can be claimed in court. If an action for maintenance is brought before the court, the court will also decide on other disputed issues such as custody, care and visiting rights if necessary.
